Waiver of family patrimony

As a spouse in a marriage or civil union, you can renounce part or all of the partition of the family patrimony. However, you cannot renounce your rights in the patrimony ahead of time, but only during legal proceedings for separation, divorce or the dissolution of a civil union, or in a deed made before a notary following the death of the other spouse.

Note

You can invoke the grounds of an unequal partition of the family patrimony if you have been subjected to a form of abuse by your former spouse, or if your former spouse acted in bad faith. In such a case, you should consult a legal adviser.
