Family patrimony

The family patrimony includes all the property acquired by a couple during their marriage or civil union, regardless of which spouse actually owns the property. This in intended to guarantee the legal and economic equality of the spouses and to ensure that each spouse obtains a fair share of the family patrimony. The rules governing the family patrimony apply whatever your matrimonial or civil union regime, and whether or not you have children.

 
The property included in the family patrimony is a follows: your main and secondary residences, the furniture and vehicles used by the family, the benefits accrued during the marriage or civil union in each spouse’s pension plan, and the benefits accrued under the Québec Pension Plan.

Note

The rules governing the family patrimony takes precedence over wills and the testamentary clauses in a marriage or civil union contract, but do not annul them. When one of the spouses dies, or when the couple separate, divorce or dissolve their civil union, the family patrimony must be partitioned.
