Division of benefits under private pension plans

Former de facto spouses may, by mutual agreement, decide to divide the benefits accrued under a supplemental pension plan.

Before deciding on division:
To make an informed decision, you can request a statement estimating the value of the benefits accrued under your pension plan. The request can be made during family mediation.

To obtain division
Within 12 months after separating, and after drawing up a written agreement, you can ask the administrator of the pension plan to proceed with division.



 

Note

For the division of benefits under a private pension plan, former de facto spouses must have lived together for three years (one year, if they have a child) and the contributing spouse must not have a legal spouse.
