If you need legal advice following a separation, it is important to know that only a lawyer who is a member of the Barreau du Québec may plead before a court and draw up legal proceedings to apply for a legal separation or divorce. Legal aid is provided free of charge (also called gratuitous legal aid) if your situation fits the eligibility criteria established by the Legal Aid Act.

Some lawyers are also certified to act as family mediators. Family mediation is offered for couples who wish to reach an agreement on all aspects of their separation. A lawyer who is a mediator will assist you in this process and draw up all the proceedings that you must file with a special clerk.
