Following the breakdown of your marriage or civil union, your private pension plan, and that of your former spouse, becomes part of the family patrimony and must be divided between you.
Before deciding on division:
You can ask to receive a statement of the pension benefits accrued if you are currently taking part in family mediation or have filed an application for divorce or legal separation with the court.
To obtain division
You must apply to the plan administrator after obtaining a judgment granting a divorce, legal separation or annulment of marriage.

You should find out how much the benefits accrued in a private pension plan are worth before waiving your right to divide the benefits.
